1. Service Overview
ChinaiAPI ("we," "us," or "our") provides a unified API gateway that aggregates and resells access to third-party Chinese AI model APIs, including but not limited to DeepSeek, Alibaba Qwen (Tongyi Qianwen), Zhipu AI (GLM), and Baidu Ernie Bot. Our service allows developers worldwide to access these models through a single OpenAI-compatible, Anthropic-compatible, and Responses API endpoint.
2. Account Registration
To use the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your API keys and credentials
- Be responsible for all activity occurring under your account
- Notify us immediately of any unauthorized use of your account
3. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Distribute malware, viruses, or other harmful code
- Engage in any activity that interferes with or disrupts the Service
- Attempt to bypass any rate limits, access controls, or security measures
- Resell or sublicense access to the Service without our express written consent
4. API Usage and Quotas
Usage is measured in a quota system. Quota is consumed based on the model used and the number of input/output tokens processed. Different models have different multiplier rates as specified on our pricing page. Quota is non-refundable except as explicitly stated in our refund policy below.
We reserve the right to impose rate limits, adjust pricing, or modify model multipliers with reasonable notice. Significant changes will be communicated via email or posted on our website.
5. Payments and Billing
All fees are stated in USD and are payable via the payment methods we support (including credit/debit cards and cryptocurrency where available). By purchasing quota, you authorize us to charge the applicable fees.
- Quota purchases are final and non-refundable, subject to Section 6 below
- Unused quota does not expire unless your account is terminated for violation of these terms
- We may change our pricing with 14 days' notice posted on our website
- All transactions are processed by third-party payment processors
6. Refund Policy
Refund requests are evaluated on a case-by-case basis. Generally, refunds may be issued in the following circumstances:
- Duplicate or erroneous charges
- Service unavailability exceeding reasonable downtime thresholds
- Technical errors that result in excessive or incorrect quota consumption
To request a refund, contact us at support@chinaiapi.com with your account email and transaction details. We aim to respond within 5 business days.
7. Service Level
The Service relies on third-party AI model providers. While we strive for high availability, we do not guarantee 100% uptime. Our liability for Service interruptions is limited as described in Section 10. We continuously monitor provider status and will make reasonable efforts to minimize downtime.
8. Intellectual Property
The Service, including its software, documentation, and branding, is owned by ChinaiAPI and protected by applicable intellectual property laws. The AI models accessed through our Service are the property of their respective providers and are subject to their own terms of use.
9. Third-Party Services
The Service integrates with and resells access to third-party AI model providers. We are not responsible for the content, policies, or practices of these third parties. Your use of third-party AI models through our gateway is subject to their respective terms of service and acceptable use policies.
10. Limitation of Liability
To the maximum extent permitted by law, ChinaiAPI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless ChinaiAPI, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for violation of these Terms. Upon termination:
- Your API keys will be deactivated
- Any remaining quota is forfeited unless the termination was our error
- Sections concerning liability, indemnification, and dispute resolution survive
You may terminate your account at any time by contacting support. No refunds will be issued for voluntary termination.
13. Changes to These Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email or site notification.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in Singapore.
